1. The promoter of this Travel Heroes Competition (“Competition”) is Columbus Direct Travel Insurance Pty Ltd, a company registered in Australia, whose registered address is at Level 13, 124 Walker Street, North Sydney NSW 2060, Australia, Tel: 1300 669 999, with registered company number ABN 99 107 050 582 ("Promoter").
  2. The Competition is only open to Australian and New Zealand residents aged 18 or over. Internet access is required. Entrants may enter the Competition by filling in the application form at https://www.smartsurvey.co.uk/s/Travel-Heroes-Enter, which is accessible via the Competition Website (“Application Form”).
  3. The Competition will run on https://www.columbusdirect.com.auTravel-Heroes (the “Competition Website”) from 10:01am on the 6th October 2016 to 10:59am on the 7th November 2016 Sydney, Australia time only (the “Competition Period”). Entries submitted after the Competition Period will not be accepted. All times referenced herein are in AEDST/AEST as applicable in NSW.
  4. Information on how to enter and the prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. In the event of any inconsistency between these Terms and Conditions and other promotional material, these Terms and Conditions shall prevail.
  5. To enter this Competition entrants must, during the Competition Period: 
    • (a) read and accept to be bound by these Terms and Conditions;
    • (b) tell us about themselves, their story and their cause or charity by completing and submitting the details as set out in the Application Form (“Application”).
  6. Participants may be invited or may choose to share content (including text, photos or videos) (“Content”) on the Promoter’s Facebook page, or submit Content to be published on the Competition Website or in any other promotional material selected by the Promoter, to support their entry. However, this is not mandatory and not part of the Competition entry process. Any Content submitted to the Promoter’s Facebook page will be subject to the Facebook Terms and Conditions.
  7. The Promoter may share notifications and competition updates via the Competition website, the Promoter’s Facebook page or via email. Participants must enter their email address in order to receive notifications of the Competition. The Promoter does not accept responsibility for entrants not receiving notification for any reason. It is the entrant's responsibility to maintain access to their email inbox, the Promoter’s Facebook page and the Competition Website to obtain an update on the Competition.
  8. The judging of all entries will take place from 10:00am on 8th November 2016 at the Columbus Direct Travel Insurance Pty Limited office, Level 13, 124 Walker Street, North Sydney, NSW 2060. The Promoter will select ten (10) finalists in accordance with clause 11. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The finalists will be notified within seven (7) days of this date via email. The Promoter will announce the ten (10) finalists on 15th November 2016. While the Promoter will make reasonable efforts to notify the finalists, the Promoter does not accept responsibility for finalists not receiving notification for any reason. It is the entrant's responsibility to maintain access to their email inbox. Entrants who have not reached the final round of the Competition will not be notified. The judges’ decision is final and no correspondence will be entered into.
  9. This is a game of skill and chance plays no part in determining the finalists or the winner.
  10. Each of the ten (10) finalists will be awarded a Finalist Pack consisting of one (1) Turkish Murkish Super Soft Towel valued at $49.95 and one (1) ecococoon Retro Chic 4 cup set valued at $39.95. Finalists can accept the Finalist Packs by following the instructions in the email the Promoter will send to notify the finalists that they have reached the final round. Any additional costs incurred by the finalists will be at their own expense. Any further details of prize delivery or collection will be shared with the finalists when they are notified they have reached the final round. The Promoter accepts no responsibility and no liability will be accepted by the Promoter if a Finalist Pack is lost or damaged whilst in transit to the finalist. If for any reason a finalist does not take / redeem the Finalist Pack (or an element of the Finalist Pack) by the time stipulated by the Promoter, then the Finalist Pack (or that element of the Finalist Pack) will be forfeited and will not be redeemable for cash.
  11. The ten (10) finalists will be selected based on the entries with the most inspiring stories in their Applications and the entrants with the most enthusiasm to share their stories and promote their cause or charity through the Competition. The Promoter’s judging panel will judge all entries and select the finalists in its absolute discretion.
  12. The ten (10) finalists accept and agree to the Promoter creating a profile for them on the Competition Website with a link where supporters can vote for them (“Profile”), with each Profile available for voting between 12:01 am on 15th November 2016 to 10:00am on 15th December 2016. Voting is only open to Australian and New Zealand residents and there is a limit of one (1) vote per person. Each finalist must also assist the Promoter in obtaining consent from their chosen charity, for the charity’s details to be provided on the Competition Website. Each finalist further agrees, if requested by the Promoter, to respond to up to four (4) email interviews on their cause or charity and travels, including supporting photos and/or videos. If a finalist declines or disregards such requests or if a finalist’s chosen charity refuses to be featured, the Promoter reserves the right to disqualify the finalist and to offer the place to another eligible entrant. In the event of a disqualification, the disqualified finalist will not receive a Finalist Pack.
  13. The Prize (as defined below) will be awarded to the finalist with the most valid votes for his/her Profile on the Competition Website.  In the event of a tie between two (2) or more finalists for the Prize, the Promoter’s judging panel will judge all tied entries and select the best entry in its absolute discretion based on the criteria in clause 11.
  14. The votes will be counted at 10:00am on 15th December 2016 at the Columbus Direct Travel Insurance Pty Limited office, Level 13, 124 Walker Street, North Sydney, NSW 2060. The winner will be announced at midday on 15th December 2016. The winner will be notified within two (2) business days of this date via email. While the Promoter will make reasonable efforts to notify the winner, the Promoter does not accept responsibility for winner not receiving notification for any reason. It is the entrant's responsibility to maintain access to their email inbox. Entrants who have not won a Prize will not be notified. The judges’ decision is final and no correspondence will be entered into. 
  15. The winner will be named Australia and New Zealand’s Travel Hero and will be awarded with AUD$500, plus the Promoter will make a one-off AUD$5,000 donation to the cause or charity the winner supports (the “Prize”). The winner can accept the Prize by following the instructions in the email the Promoter sends to notify the winner that he/she has won. Any additional costs incurred by the winner will be at their own expense. The winner’s chosen charity must also accept the donation from the Promoter; in the event that the winner’s charity refuses to accept the donation, the winner will then be disqualified, will not receive any prize and an alternative winner will be chosen by the Promoter.
  16. Total prize pool value is $6,399.
  17. The Prize is to be awarded in the form of EFT.
  18. By accepting the Prize, the winner accepts and agrees to a final interview with the Promoter within seven (7) days after the end of the Competition Period. The winner further agrees, if requested by the Promoter, to provide up to four (4) email updates on their cause or charity and travels, including supporting photos and/or videos, throughout the course of 2017. The timing and format of the updates will be arranged between the winner and the Promoter to suit both parties’ schedules.
  19. The entrants’, finalists’ or winner’s charitable causes or the charitable organisations, or any Content provided by entrants, do not represent the stance, position or view of the Promoter. The Promoter reserves the right to immediately disqualify entries where the cause or charity supported is incoherent or inconsistent with the Promoter’s brand values.
  20. Only one (1) entry per person is permitted and only one (1) entry is permitted per email address. All entries by anyone found to use multiple email addresses to enter will be declared invalid and disqualified from this Competition. The Promoter reserves the right, at any time to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts.
  21. Incomplete or indecipherable entries will be deemed invalid.
  22. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  23. No purchase is necessary to enter. No entries from agents, third parties, organised groups, syndicates or Applications automatically generated by computer will be accepted. No incomplete, delayed in transit, automatically generated by computer, illegible, corrupted entries or entries from multiple accounts will be accepted. In the event of this clause being breached, the entrant will be disqualified and any Prize awarded will be void. Any malicious or manipulative attempt to influence the Competition outcome will result in disqualification at the sole discretion of the Promoter. If there is any reason to believe that there has been a breach of these Terms and Conditions or incorrect, illegible, fraudulent or other invalid or improper information has been provided, the Promoter may, at its sole discretion, refuse to fulfil the Prize.
  24. The Competition is not open to: employees of the Promoter or its holding or subsidiary companies or their families, or anyone else who is connected to this Competition, including third party promotional partners.
  25. Content and Applications used to enter into this Competition must be the original independent work of the entrant and must not have been previously published. Entries must not have won prizes or awards in other competitions or be restricted in any way. Entrants confirm they have all necessary consents and releases in order to enter their Content and Applications into this Competition. For clarity, Content and Applications do not need to be created during the Competition Period itself.
  26. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age, Facebook account and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. Entries which are not or appear not to be in accordance with these Terms and Conditions may be disqualified.
  27. The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts; and/or (b) to disqualify any entrant (or invalidate his/her entry) that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for votes or has otherwise encouraged or procured any person to submit votes contrary to these Terms and Conditions.
  28. Entrants agree that they are fully responsible for any materials they submit via the Competition including but not limited to Content and Applications. The Promoter shall not be liable in any way for such Content and Applications to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that entries (including but not limited to Content and Applications ) for this Competition cannot:
    • (a) Infringe the copyright or other intellectual property rights of any third party;
    • (b) Be violent, negative or/and discriminative of any ethnic, racial, gender, religious, professional or age group, or be profane or obscene;
    • (c) Promote or be about the use of illegal drugs, tobacco, firearms/weapons, any activities that may appear unsafe or dangerous, or any particular political agenda or message;
    • (d) Be offensive or be about hate;
    • (e) Defame, misrepresent or contain negative remarks about the Promoter or its products, other people, products or companies;
    • (f) Contain trademarks owned by others or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, email addresses or street addresses;
    • (g) Contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media or musical "samples") without permission;
    • (h) Contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead without permission;
    • (i) Communicate messages or images inconsistent with the positive images and/or goodwill to which the Promoter wishes to associate;
    • (j) Depict, and cannot itself be in, violation of any law; or
    • (k) Contain viruses or cause injury or harm to any person or entity.

    Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

  29. The Promoter reserves the right not to publish entries or to remove entries from the Competition Website or the Columbus Direct Travel Insurance Australia and NZ Facebook page for any reason and without notice.
  30. Any inappropriate or offensive material may be reported to the appropriate authorities.
  31. If for any reason the winner does not take/redeem the Prize (or an element of a Prize) then the Prize (or that element of the Prize) will be forfeited.
  32. Entrants will retain copyright in their submitted entries, however, by entering, all entrants licence the Promoter, its affiliates and sub-licensees, an exclusive worldwide perpetual licence to use, edit, publish, reproduce, distribute, make available, modify and use the entries and other Content and Applications provided to the Promoter, in whole or in part, in any and all media (including print and online) without any further reference, payment or other compensation to the entrant. The Promoter reserves the right to publish entries (including parts of entries) although publication does not necessarily mean the entrant has won the Prize. Entrants consent to any use of their entries and other Content and Applications which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights.
  33. Entry is free but entrants should be aware that they may be subject to charges depending on their own individual arrangements for Internet access. Any costs associated with an individual entering the Competition are the responsibility of the entrant and are dependent on the Internet service provider used.
  34. There is no other alternative to the prizes stated and neither of the prizes are transferable or exchangeable and no part or parts of a prize may be substituted for other benefits, items or additions.
  35. The use of any automated entry or voting software or any other mechanical or electronic means that allows an entrant to automatically enter or vote repeatedly is prohibited and will render all entries/votes submitted by that entrant invalid.
  36. By entering, entrants agree to allow the free use of their name, likeness, image, voice, photographs and general locations for publicity and news purposes and any other reasonable and related promotional purposes during this and future promotions by the Promoter without remuneration but other than as detailed in these terms. Under no circumstances will the participants’ personal data be published without prior written permission from the participants.
  37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
  38. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of or taking a Prize.
  39. The Promoter accepts no responsibility or liability for loss or damage arising from an inability to enter the Competition due to computer failure, viruses, bugs and other such similar causes, lost, delayed or incomplete entries howsoever arising.
  40. Entry to the Competition is dependent upon the entrant entering the Competition via online access not under the ownership or control of the Promoter. The entrant accepts and acknowledges that the Promoter has no liability for loss or damage arising from the entrant interacting with those third party computer systems or similar or any failure, bug, error, corruption or virus in or caused by those third party computer systems or similar.
  41. The Promoter reserves the right, in its absolute discretion, to exclude entrants and withhold the Prize for violating any of these Terms and Conditions.
  42. In entering this Competition, entrants confirm that they are eligible to do so and eligible to claim the Prize. The Promoter may require the winner/s to provide proof that they are eligible to enter the Competition.
  43. The Promoter reserves the right at any time to cancel, modify or supersede the Competition, to the fullest extent permitted by law, (including altering prizes) if, in it’s sole discretion, it deems that the Competition cannot be conducted as specified or is interfered with in any way. The Promoter reserves the right to substitute a prize of equal value and or specification in the event of any unforeseen circumstances beyond its control making this unavoidable.
  44. Uses of personal data received by the Promoter in the course of the Competition are subject to the privacy policy found on the Promoter’s website. The name of the finalists and winner may be published on the Promoter’s website at https://www.columbusdirect.com.au and/or https://www.columbusdirect.co.nz.
  45. The name of the winner may be obtained by sending a signed request along with a stamped self-addressed envelope detailing your request to Marketing Manager, Columbus Travel Insurance Pty Limited, Level 13, 124 Walker Street, North Sydney, NSW 2060.
  46. This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook. The entrants agree that they are providing their information to the Promoter, not to Facebook. By entering the Competition, all participants agree to a complete liability release for Facebook. All entries and any content shared on Facebook in relation to the Competition will be subject to Facebook’s terms of use which can be found at https://www.facebook.com/legal/terms. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
  47. This Competition is in no way sponsored, endorsed or administered by, or associated with any charitable organisations.
  48. The Promoter collects personal information ("PI") in order to conduct the Competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and Prize suppliers. Entry is conditional on providing this PI. Any personal information of entrants that is collected during this Competition will be used, stored and disclosed in accordance with the Promoters Privacy Policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter may disclose entrant’s personal information to entities outside of Australia, for a full list of countries please see the Promoter’s Privacy Policy.
  49. All and any promotional materials and instructions provided at the point of entry form part of these Terms and Conditions and, in the event of a conflict, these Terms and Conditions take precedence.
  50. If any provision of these Terms and Conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
  51. The laws of Australia apply to this Competition to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
